Three days before the execution, one of the convicts in the Nirbhaya gangrape and murder case has filed a petition in a Delhi court claiming that he was not in Delhi on the day of the crime.

The petition has been moved by convict Mukesh Singh’s legal representative ML Sharma seeking a stay on the hanging slated for 5:30 am on 20th March.

The Delhi court reserved its order on the plea. It is anticipated to pronounce the verdict later in the day.

This comes after three of the four convicts approached the International Court of Justice seeking a stay on the execution of their death sentence. The application before the ICJ was filed by Akshay Thakur, Pawan Gupta and Vinay Sharma.

The Supreme Court on Monday rejected the petition placed by Mukesh Singh, seeking restoration of his legal remedies claiming that his previous lawyer misguided him.

The petition, put in via advocate ML Sharma, seek a CBI investigation into alleged ‘criminal conspiracy’ and ‘fraud’ hatched by the Centre, the Delhi government and lawyer Vrinda Grover, who is the amicus in the matter.

On 5th March, a trial court issued fresh death warrent – the fourth in the matter – for 20 March.

These men were convicted for gang-raping and murdering a 23-year-old women in a moving bus in south Delhi on 16th December, 2012. She succumbed to injuries on 29 December at a hospital in Singapore.
